Please read these terms and conditions (“terms”) carefully before
downloading the Some1 mobile application software (“App”) onto
your mobile telephone or handheld device (“device”).
What’s in These Terms?
These terms tell you the rules for using our App, Some1.
Who We Are and How to Contact Us?
Some1 is an app created and operated by SOME1 (PTY) LTD (”We/Us”).
We are a private company duly registered and incorporated in the Republic
of South Africa under Registration Number 2019/212325/07 and carry on
business from 2 van Dort Road, Bedfordview, 1401, South Africa.

Nature of Business
The purpose of Some1 is to provide a digital visitor management platform
to users and their visitors in order to simplify visitor sign-ins.
By Using Some1 You Accept These Terms
By using Some1, you confirm that you accept these terms of use and that
you agree to comply with them.
If you do not agree to these terms, you must not use Some1.
We recommend that you print a copy of these terms for future reference.
Acceptable use of Some1
By accessing Some1, you agree that you will not:-
- violate any laws;
- be false or misleading;
- infringe any third party rights;
- distribute viruses or any other technologies that may harm Some1 or the interests or property of Some1’s users;
- impose an unreasonable load on Some1’s infrastructure or interfere with the proper working of Some1;
- copy, modify, or distribute any other person’s content without their consent;
- harvest or collect information about other users, including email addresses, without their written consent; and/or
- bypass measures used to prevent or restrict access to Some1.
You are solely responsible for all information that you submit to Some1 and
any consequences that may result from what your post. We reserve the
right at our discretion to refuse or delete information that we believe is
inappropriate or breaching these terms. We also reserve the right at our
discretion to restrict a user’s usage of Some1 either temporarily or
permanently or refuse a user’s registration.
There Are Other Terms That May Apply to You
These terms of use refer to additional terms, which also apply to your use
of Some1. Our Privacy Policy [INSERT AS LINK TO APP’S PRIVACY
POLICY], which sets out the terms on which we process any personal
information we collect from you, or that you provide to us. By using Some1,
you consent to such processing and you warrant that all information
provided by you is accurate.
We may make changes to these terms
We may amend these terms from time to time. Every time you wish to use
Some1, please check these terms to ensure you understand the terms that
apply at that time. These terms were most recently updated in March 2021.
We may make changes to Some1
We may update and change Some1 from time to time to reflect changes to
our products, our user’s needs, and/or our business. We will try to give you
reasonable notice of any major changes.
We may suspend or withdraw Some1
Some1 is made available free of charge.
We do not guarantee that Some1, or any content on it, will always be
available or be uninterrupted. We may suspend or withdraw or restrict the
availability of all or any part of Some1 for business and operational
reasons. We will try to give you reasonable notice of any suspension or
withdrawal.
You Must Keep Your Account Details Safe
If you choose, or you are provided with, a username, password, or any
other piece of information as part of our security procedures, you must treat
such information as confidential. You must not disclose it to any third party.
We have the right to disable any username or password, whether chosen
by you or allocated by us, at any time, if in our reasonable opinion you have
failed to comply with any of the provisions of these terms of use.
If you know or suspect that anyone other than you know your username
and/or password, you must promptly notify us at info@some1.io.
How You May Use Material On Some1
We are the owner of all intellectual property rights on Some1, and in the
material published on it. Those works are protected by copyright laws and
treaties around the world. All such rights are reserved.
If you download any part of Some1 in breach of these terms of use, your
right to use Some1 will cease immediately and you must, at our option,
delete the Some1 from your device.
Do Not Rely on Information on Some1
The content on Some1 is provided for general information only.
Although we make reasonable efforts to update the information on Some1,
we make no representations, warranties, or guarantees, whether express or
implied, that the content on Some1 is accurate, complete, or up to date.
User-Generated Content Is Not Approved By Us
Some1 may include information uploaded by other users of Some1. This
information and these materials have not been verified or approved by us.

Limitation of Liability
To the full extent permitted by the laws of the Republic of South Africa, we
disclaim all warranties, express or implied. We do not warrant that Some1
is free of viruses or other harmful components. Therefore, we will not be
liable for any loss or damages of any kind arising from the use of Some1,
including but not limited to special, direct, indirect, incidental, punitive and
consequential damages, economic or other commercial loss, loss of
revenue, or profit, lost or damaged data. Your sole remedy is to discontinue
using Some1.
Uploading Information to Some1
Whenever you make use of a feature that allows you to upload information
to Some1, or to make contact with other users of Some1, you warrant that
any such contribution complies with these terms, and you will be liable to
us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
Any information you upload to Some1 will be considered non-confidential
and non-proprietary. You retain all of your ownership rights in your
information, but you are required to grant us a limited license to use store
and copy that information and to distribute and make it available to third
parties.
Rights You Are Giving Us to Use Material You Upload
When you upload or post information to Some1, you grant us the following
rights to use that content: LICENCE GRANTED TO THE APP OWNER.
We Are Not Responsible for Viruses and You Must Not Introduce
Them
We do not guarantee that Some1 will be secure or free from bugs or
viruses.
You are responsible for configuring your device/s to access Some1. You
should use your own virus protection software.
You must not misuse Some1 by knowingly introducing viruses, trojans,
worms, logic bombs, or other material that is malicious or technologically
harmful. You must not attempt to gain unauthorized access to Some1, the
server on which Some1 is stored, or any server, computer, or database
connected to Some1. We will report any such breach to the relevant law
enforcement authorities and we will co-operate with those authorities by
disclosing your identity to them. In the event of such a breach, your right to
use Some1 will cease immediately.
Breach of Terms
If you are in breach of these terms of use, we reserve the right to
discontinue all or any part of Some1 and restrict or prohibit your access to it.
You hereby agree to indemnify us against any cost, claims, losses and
damages (including legal fees) incurred by or awarded against us as a
result of your misuse of Some1 or your breach of these Terms.
Termination of Terms
Some1 shall be entitled to terminate these terms at its sole and absolute
discretion and reserves the right to discontinue all or any part of the Some1
and to restrict or prohibit your access to it at any time.
Which Country’s Laws Apply to Any Disputes?
These terms of use, their subject matter, and their formation (and any non-contractual disputes or claims), are governed by the laws of the Republic of
South Africa. You and we both agree that the courts of South Africa will
have exclusive jurisdiction to adjudicate any dispute arising out of or in
connection with the use of Some1 and/or the terms contained herein.
General
You may not cede, assign or otherwise transfer your rights and obligations
in terms of these terms to any third party.
Any failure on the part of you or Some1 to enforce any right in terms hereof
shall not constitute a waiver of that right.
No variation, addition, deletion, or agreed cancellation of these terms will
be of any force or effect unless in writing and accepted by or on behalf of
the parties hereto.
No indulgence, extension of time, relaxation, or latitude which any party (the “grantor”) may show, grant, or allow to the other (the “grantee”) shall
constitute a waiver by the grantor of any of the grantor’s rights and the
grantor shall not thereby be prejudiced or stopped from exercising any of its rights against the grantee which may have arisen in the past or which might arise in the future.
These terms contain the whole agreement between you and Some1 and no
other warranty or undertaking is valid unless contained in this document
between the parties.
In the event that any of the terms are found to be invalid, unlawful or
unenforceable, such terms will be severable from the remaining terms,
which will continue to be valid and enforceable.
